Abstract

Praise be to God, and prayers and peace be upon the Messenger of Allah, and on his family and companions and the Aah.
After:
     The legal controls of the contracts of financial transactions in Islam, create a balance between the layers of society; because it is the cornerstone of many commercial transactions of human communities; because it is the solution to all the crises and hardships that occur in the global financial markets; as legitimate controls exacted by the wise street, And the ignorance of people today types of sales and transactions, and naming contracts without their names, and the greed of traders, they have become a fictional sales they call them names of legitimacy to solve what God has forbidden usury.
     In the course of my research, I have collected what is differentiated by the Islamic jurisprudents and the scholars of our great schools. And banks with each other and with customers, therefore focused in this research on the vague issues with the liberation of the conflict between the owners of contemporary views are not agreed upon.
And divided it to achieve its goal to an introduction and two articles and a conclusion:
The first topic: What are the sales of the secretariat and its departments, which include two requirements:
First: Definition of the sale, legitimacy and terms of Murabaha.
The second requirement: contemporary image.
The second topic: Selling murabaha to the buyer and guaranteeing two requirements:
The first requirement: its definition and legitimacy.
The second requirement: evidence and discussion and jurisprudence.
     In conclusion, it collected the most important findings of the results and stated recommendations and solutions that can address the imbalance that occurs in some contracts for the sale of Murabaha for the purchase order.
I ask Allah Almighty to make my work pure and right for His holy face ... May Allah bless our master and our beloved Muhammad and his family and companions, and make our Sunnah follow and understand His companions, and guided by the scholars' approach.
